Please read these Terms and Conditions ("Terms") carefully before using the DailyTallies mobile application (the "App") operated by DailyTallies ("we", "our", or "us").
1. Acceptance of Terms
By accessing or using the App, you agree to be bound by these Terms. If you disagree with any part of these Terms, you may not access or use the App.
2. Use of the App
2.1 Eligibility
You must be at least 13 years old to use this App. If you are under 18, you must have permission from a parent or legal guardian.
2.2 Account
You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.
2.3 Acceptable Use
You agree to use the App only for lawful purposes. You agree not to:
- Violate any applicable laws or regulations
- Infringe upon the rights of others
- Transmit any harmful, offensive, or inappropriate content
- Attempt to gain unauthorized access to the App or its systems
- Interfere with or disrupt the App's functionality
3. Health and Wellness Disclaimer
DailyTallies is a habit-tracking tool designed for personal productivity and self-improvement. The App is not intended to provide medical, psychological, nutritional, or fitness advice, diagnosis, or treatment. Any habits, goals, or tracking data you log are for your personal reference only.
Always consult with a qualified healthcare professional before making significant changes to your health, fitness, diet, or wellness routines. If you are experiencing a medical or mental health emergency, contact emergency services immediately.
4. Premium Features and Subscriptions
4.1 Subscriptions
The App offers premium features through auto-renewable in-app subscriptions. Subscription management is facilitated through RevenueCat and is subject to the terms of the applicable app store.
4.2 Payment and Auto-Renewal
Subscription fees are charged to your payment method on file. Subscriptions automatically renew at the end of each billing period unless cancelled at least 24 hours before the end of the current period. Prices may vary by region and are subject to change with notice.
4.3 Cancellation
You may cancel your subscription at any time through your device's subscription settings. Cancellation will take effect at the end of the current billing period.
4.4 Refunds
Refund requests are handled according to the policies of the app store through which you made the purchase.
5. User Content
You retain ownership of all content you create or enter into the App, including habits, tally counts, goals, notes, and related tracking data. By using the App, you grant us a license to store, process, and display your content solely for the purpose of providing the App's services to you.
6. Intellectual Property
The App and its original content, features, and functionality are owned by DailyTallies and are protected by international copyright, trademark, and other intellectual property laws.
7. Disclaimer of Warranties
The App is provided "as is" and "as available" without warranties of any kind, either express or implied. We do not warrant that the App will be uninterrupted, error-free, or free from viruses or other harmful components. We do not guarantee that use of the App will result in any specific outcome, including the formation or maintenance of any habit or personal goal.
8. Limitation of Liability
To the maximum extent permitted by law, DailyTallies shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses resulting from your use of the App.
9. Indemnification
You agree to indemnify and hold harmless DailyTallies and its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including legal fees) arising out of or relating to your use of the App or violation of these Terms.
10. Termination
We may terminate or suspend your account and access to the App immediately, without prior notice, for any reason, including breach of these Terms.
11. Changes to Terms
We reserve the right to modify or replace these Terms at any time. If a revision is material, we will provide at least 30 days' notice prior to any new terms taking effect. Your continued use of the App after any changes constitutes acceptance of the new Terms.
12. Governing Law
These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which DailyTallies operates, without regard to its conflict of law provisions.
